Credit Reporting Agencies “Ignore Evidence” Against Their Erroneous Reports

If you’re unlucky, then it will be extremely difficult for you to get credit agencies to accept they messed up. This is at least from the view of a certain Tom Tupper, who saw his credit score take a 48-point hit from a payment he was never delinquent on.

Tupper likes monitoring his credit reports, and found out that TransUnion noted he was 30 days late on a car loan payment. He proceeded to sell the car, made an extra payment for good measure and kept records of all his payments to loan-servicing company Santander Consumer USA.

Santander marked Tupper as a delinquent deadbeat.

Tupper disputed the claims, was denied by TransUnion, disputed again while sending a folder piled with payment documents and was denied once again. He now can’t make any disputes with TransUnion as any further disputes would be marked as frivolous.

Tupper, however, had an ace up his sleeve – a consumer right to dispute directly with the loan furnisher if a dispute with the credit bureau fails. Santander finally changed Tupper’s report, and a happy ending ensues.

That consumer rights is what you need to keep in mind the next time credit agencies refuse to acknowledge your legitimate claims.
